How Do You Revive Old Leads With AI Without Breaking the Rules?

Why do old leads respond at all?

Because they already asked. A lead from six months ago filled out a form, called, or messaged you about something they needed. Many never heard back in time, which is the same problem speed to lead describes, and some still have the need. A reactivation campaign is a second, faster reply to people who have already raised their hand.

Which old leads can you legally text or call?

Sort every lead by what they agreed to, before any message goes out.

  • Automated or AI-voice marketing needs written consent. Under the federal TCPA rules (47 CFR 64.1200), a call or text sent with an autodialer or an artificial or prerecorded voice needs the person's prior express consent, and if it is marketing, their prior express written consent. That written consent must name your business and the phone number and say that consent is not a condition of purchase. A checked box on a web form can provide it.
  • An AI voice counts as an artificial voice. In February 2024, the FCC ruled that the TCPA's limits on artificial or prerecorded voices cover AI-generated voices, so an AI agent calling old leads needs the same consent a robocall would. Since a 2025 Supreme Court decision, courts read the TCPA for themselves rather than deferring to the FCC, but the safe practice is still to treat an AI voice as artificial.
  • Consent has no expiration date, but other things age. No federal rule sets an expiration date for consent. What does age is the existing business relationship exemption from the Do Not Call rules: 18 months after a purchase or transaction, and 3 months after an inquiry. It gets you past the Do Not Call list, not past the written consent automated marketing needs.
  • Opt-outs are broad and must be honored fast. Since April 11, 2025, people can revoke consent by any reasonable method. Replies such as stop, quit, end, revoke, opt out, cancel, and unsubscribe count automatically, and you must honor them within 10 business days. Requests not to be called by your business are honored for five years. The FCC voted in September 2026 to adjust parts of the revocation rules, so check the current version before you send.
  • Florida adds its own rules. The Florida Telephone Solicitation Act requires prior express written consent for sales calls and texts that use an automated system to select and dial numbers, and accepts a checked box or a "yes" text reply as the signature. If a person replies STOP to a text, the business has 15 days to stop. The Florida Telemarketing Act limits solicitation calls to between 8 a.m. and 8 p.m. local time, and to three calls per person in 24 hours on the same subject.

How do you clean the list before sending?

Run every number through the same checks:

  1. Consent on file. Keep where and when each person opted in, and the exact wording they saw, so it can be shown later.
  2. Opt-outs removed. Anyone who ever replied STOP, asked not to be contacted, or opted out another way stays off the list.
  3. Do Not Call scrub. Telemarketing calls and texts to numbers on the National Do Not Call Registry need written consent or an existing business relationship. Check the list against the registry within 31 days of sending, the window the rules use for their good-faith safe harbor, and against your own do-not-call list.
  4. Reassigned numbers checked. Numbers change hands. The FCC's Reassigned Numbers Database tells you whether a number was disconnected after the person gave consent, and checking it is part of the rules' safe harbor.
  5. Duplicates merged. One person, one conversation, even if they inquired three times.
  6. Timing set. Federal rules bar telephone solicitations before 8 a.m. or after 9 p.m. in the recipient's time zone, and Florida's window is 8 a.m. to 8 p.m. Sending between 9 a.m. and 7 p.m. local time keeps you inside both.

What should the first message say?

Who you are, why you are writing, and one easy question. For example:

Hi Maria, this is the front desk at [your practice]. You asked about teeth whitening with us in March. We have openings next week if you'd still like to come in. Want me to send a few times? Reply STOP to opt out.

Short, specific, and easy to answer. No links in the first message, no pressure, and the opt-out in every message.

What should the AI do when someone replies?

Pick up the conversation the way a good front desk would: answer questions, offer times, and book directly into the calendar. Anything about price exceptions, complaints, or a person who wants to talk to someone goes to a person, using the same human-in-the-loop handoff rules as any other workflow. A reply of STOP ends the conversation immediately and permanently.

How do you measure a reactivation campaign?
